If you’re making a housing disrepair claim, you should inform your landlord by text, email, in person, or by letter and give them 21 days to respond before filing the claim.

It’s important to give them a chance to fix the problem first. If they don’t make the repairs in a reasonable time, you can still pursue a compensation claim.

The Landlord and Tenant Act 1985 requires tenants to repair any damage they or their visitors cause to the property. To protect both parties, it’s a good idea to take an inventory before tenants move in, listing the property’s contents and condition. If any damage occurs, tenants are responsible for covering the cost of repairs or replacements. If they don’t, the landlord can deduct the cost from the deposit at the end of the tenancy.

However, normal wear and tear—like minor scuffs on walls or general painting—should be expected and not charged to the tenant.

Any belongings left behind by a tenant still belong to them. If you dispose of the belongings without permission, the tenant could take legal action against you.

The first step is to try to contact the tenant and ask them to collect their belongings. You will need to send a notice under the Torts (Interference with Goods) Act 1977, informing the tenant that you plan to sell or dispose of their items if they aren’t collected within a reasonable time.

Whether your landlord can increase the rent, will depend on what tenancy you have. There are certain rules and notice periods your landlord will have to provide, depending on if you have an Assured Shorthold Tenancy, are within a fixed term or if there is a rent review clause.

You should try and reach an agreement with your landlord and if this is not possible, you can refer the matter to the Property Tribunal for a decision.

Depending on the circumstances, the tenants should first be contacted to advise of the situation and why you wish for them to leave the property.
